    All aspects of Children’s Law and Education
    Everything relating to Child law matters from initial advice, care proceedings, applications and adoption, with advocacy in courts at all levels and advising to Adoption and Fostering services. We advise schools on all aspects of education law, regularly representing both school and the Council in the HESC Chamber of the First-Tier Tribunal. We offer advice on all aspects of policy, particularly school organization and Special Educational Needs.

    All aspects of adult social care, mental health, immigration and deputyship
    In the area of adult social care we advise on everything from ordinary residence, safeguarding and Court of Protection to advice on drafting policy and strategy. We are experts in residential care funding, in conducting judicial review proceedings and the Care Act.

    Our Mental Health Team advises on all aspects of mental capacity and mental health. We provide comprehensive advice on immigration.


    ProjectsPROJECTS

    We provide legal support and project management expertise to public authorities. The Projects Team have extensive experience in contract law, public procurement, regeneration, commercial property and local government law and a long history of undertaking cutting edge work on behalf of public  authorities.

    Some large projects that have benefitted from our advice include Highways Strategic Transformation, Building Schools for the Future, Waste PFI, Children’s Centres, Outsourcing, Slough Libraries, Adults IT and Social Impact Bonds.


    RegenerationREGENERATION

    The Regeneration Team deals with all aspects of the law relating to regeneration projects ranging from the procurement and strategy for selection of development partners through to planning, compulsory purchase, land assembly, disposal and associated side agreements under S106 Town and Country Planning Act 1990 and S278 Highways Act 1980. Our experience encompasses deep sector knowledge of highways and environmental issues which often affect development.

     

    PlacePLACE

    Highways and Environment Law
    The largest legal department in ELS dealing with the work on the environment (highways, planning and  waste) and conveyancing which flows from all services across the County Council and other clients. We work in the area of the Commons Registration Authority functions (including searches, new application for registration and applications to vary rights) and modifications of the Definitive Map under Schedule 14 Wildlife and Countryside Act 1981. We advise on common land and village greens and applications to vary register, land drainage, coast protections and country parks. This department is skilled in all issues associated with highways law.

    Property Law
    We are experts in sales, acquisitions, leases, licences, easements, wayleaves, consents to waive restrictive covenants, indemnities, tenancy advice and Land Compensation Act claims.

    Planning Law
    Our expertise spans diverse areas of work including: planning enforcement advice, planning advice including policy issues, Section 106 Town and Planning Act Agreements for planning, education and highways clients, interpretation of development agreements, land registry searches for clients, drainage of highways, bridges, dissemination of information relating to case law and statutory reviews, support for committee functions and input to the development plan process. We specialise in commons and village green matters.

     

    DisputesDISPUTE RESOLUTION

    Employment
    We deal with claims in Employment Tribunals with our focus being on proactive interventions to prevent claims. Our work includes providing advice at the earliest stage, giving input into the development of  client HR policies, producing and delivering training and advising on new case law and legislation. We also provide general employment advice on TUPE as well as advice on compromise agreements, the new disciplinary and grievance procedures, service level agreements and pensions. The department is particularly skilled in dealing with public authority law matters with a unique practical experience of TUPE (both incoming and outgoing).

    Advocacy/Enforcement
    This department deals with Advocacy, Enforcement and Childcare. In the area of crime, our work consists of prosecuting trading standards breaches, education matters (non-attendance and exclusions), probation breaches and environment and highways breaches. Clients include Trading Standards, schools and district councils. Public Interest Immunity Law is applied to criminal court orders for disclosure. The department has particular expertise in dealing with Local Authority law matters and work well with the police and the local criminal courts to ensure that proper disclosure is made and that the criminal trials are not hampered. The Childcare Advocates within this team specialise in lengthy, complex and contentious childcare proceedings on behalf of social services. They are experts within their field and hold Rights of Audience in the Higher Courts.

    Claims Handling
    The Claims Handling team has particular expertise in dealing with claims against local authorities including pothole claims, property damage, failure to educate, false imprisonment, Social Service negligence, defamation, malfeasance in public office, tree subsidence claims, vehicle damage and recovery claims. The team provides advice and assistance in relation to all aspects of insurance liability claims.

    Personal Injury and Civil Litigation
    In this department we have particular expertise in dealing with claims against public bodies including property damage, failure to educate, false imprisonment, Social Services negligence, defamation, malfeasance in public office, tree subsidence claims, vehicle damage and recovery claims. We offer advice and assistance in relation to all aspects of insurance liability claims.

    We handle all aspects of civil litigation including judicial review, possession proceedings and litigation and general legal advice arising out of: commercial tendering, company law, contract, environment law, land law, planning, landlord and tenant law, employment law and trust law. We have considerable experience in dealing with judicial review, contract breach and debt recovery. Our experience includes all court forums from local County Courts through to the Supreme Court and European Court.
